Terms of Service

On-Site and In-Home Service Agreement

Prior to any service activities by a Allied Enterprise Network Solutions, L.L.C. service technician, the backup (transfer or copy of files, folders, and/or programs to a storage medium separate from the computer being serviced) of any and all files that the customer wants to retain for use, on the computer to be serviced, after the service requested has been completed, needs to be addressed. The customer hereby agrees, initials, and acknowledges that he/she takes full responsibility for backing-up the computer system’s files, in part or in whole, prior to the scheduled appointment time for service by Allied Enterprise Network Solutions, L.L.C.. Allied Enterprise Network Solutions, L.L.C. highly recommends that the customer back’s-up all information on the hard drive prior to any installation or service by Allied Enterprise Network Solutions, L.L.C. or any other service professional. Allied Enterprise Network Solutions, L.L.C. is not responsible for loss or alterations of any kind to data or information in any form that exists or existed on the computer to be serviced prior to the service activities.

The customer is responsible for any and all files that the customer wants to be retained after service by Allied Enterprise Network Solutions, L.L.C.. If for any reason the back-up process is not complete upon arrival of Allied Enterprise Network Solutions, L.L.C. technician, the customer can choose between one of the following options:

Proceed with the service without completing the file back-up procedure.
Pay $159.00 charge for Allied Enterprise Network Solutions, L.L.C. to perform back-up procedure.
Pay $45.00 house call cancelation fee and reschedule an appointment for Allied Enterprise Network Solutions, .L.C. to return when files are backed-up.

 
Legal Notification:

If, in the normal course of performing the technical services authorized by the customer, Allied Enterprise Network Solutions, L.L.C., including any member of its staff, encounters what appears to be illegally acquired or possessed data, software, images, equipment, or any other aspect of the computer under repair, and only limited to the computer under repair, we at Allied Enterprise Network Solutions, L.L.C. reserve the right to notify law enforcement officials as an act of legal, moral, or ethical responsibility.
 

THESE TERMS OF SERVICE APPLY TO SERVICES ("PAY FOR SUPPORT", "IN-STORE SERVICE", “ON-SITE SERVICE” AND “IN-HOME SERVICE”) REQUESTED FROM ALLIED ENTERPRISE NETWORK SOLUTIONS, L.L.C. OVER THE PHONE, IN-STORE OR EMAIL. THE TERMS OF SERVICE APPLICABLE TO SERVICES REQUESTED ARE PROVIDED AT THE TIME THE SERVICE IS PURCHASED AND MAY DIFFER FROM THE TERMS STATED HERE.

TERMS OF USE

SUPPORT & SERVICES

(a) Services: Allied Enterprise Network Solutions, L.L.C. will attempt problem diagnosis and a solution over the telephone for an applicable fee. In certain cases, however, problem diagnosis and support may not be completed because of a problem with your computer or its configuration and will have to be brought to the store for additional service.

(b) User Responsibility: You understand and agree that prior to contacting or allowing Allied Enterprise Network Solutions, L.L.C. to perform diagnostic repair on your computer, it is your responsibility to back-up the data, software, information or other files stored on your computer disks and/or drives. You acknowledge and agree that Allied Enterprise Network Solutions, L.L.C. shall not be responsible under any circumstance for any loss or corruption of data and/or software.

PAY FOR SUPPORT, IN-STORE SERVICE, ON-SITE SERVICE, IN-HOME SERVICE

(a) Scheduling: Standard service hours are Monday-Friday, 9 AM- 5 PM. Rush fee charges will apply for rapid response services, and after hours fee for service outside of standard service hours.

(b) Service Jurisdiction: Allied Enterprise Network Solutions, L.L.C. sets the Service Jurisdiction for each city and location. If a location lies beyond Allied Enterprise Network Solutions, L.L.C. standard Service Jurisdiction, additional trip charges will apply. To determine if your location is within the Allied Enterprise Network Solutions, L.L.C. standard Service Jurisdiction; please call Allied Enterprise Network Solutions, L.L.C. at (641) 430-1584 for information pertaining to standard Service Jurisdictions and applicable trip charges.

(c) An Adult Must Be Present At Residences or Business: For on-site services, a person of at least 18 years of age must be present during the entire time period services are provided. If the Allied Enterprise Network Solutions, L.L.C. Technician arrives at the scheduled service time and no adult is present, services will be denied and a $45.00 cancellation charge will be assessed.

(d) Backup Your Software and Data: It is your responsibility to backup all software and data that is stored on your computer’s hard disk drive(s) and/or on any other storage devices you may have prior to the arrival of the Allied Enterprise Network Solutions, L.L.C. Technician to your home or business. Allied Enterprise Network Solutions, L.L.C. and/or its third party service provider shall not be responsible at any time for loss, alteration or corruption of any software, data or files.

(e) Access: The Allied Enterprise Network Solutions, L.L.C. Technician must receive full access to the computer(s) and/or peripheral(s) to be serviced, access to your residence, your consent and cooperation to enter your residence or business, and a safe working environment, working space and electrical power. If the Allied Enterprise Network Solutions, L.L.C. technician arrives at the scheduled service time and determines that he/she does not reasonably have access, cooperation, or safe working area described in the previous sentence, then services will be denied and a $45.00 cancellation charge will be assessed.

(f) Minimum System Requirements:

    4GB RAM or Greater Windows 10 32-bit
    4GB RAM or Greater Windows 10 64-bit
    WPA2 Encryption Capable Router
    High Speed Internet Access


TERMS APPLICABLE TO PAY FOR SUPPORT, IN-STORE, ON-SITE AND IN-HOME SERVICES:

LIMITATIONS TO SERVICE: Allied Enterprise Network Solutions, L.L.C. and/or its third party service providers reserves the right to refrain from providing any or all services ordered and instead refund the customer’s pre-payment (if pre-payment was made), wholly or in part, on the basis that the minimum system requirements are not met.

FORCE MAJEUR: If Allied Enterprise Network Solutions, L.L.C. and/or its third party service provider’s ability to render services is impaired by you or circumstances beyond the control of Allied Enterprise Network Solutions, L.L.C. and/or its third party service provider, Allied Enterprise Network Solutions, L.L.C. and/or its third party service provider may choose not to provide services.

LIMITATION OF REMEDY: Under no circumstances shall Allied Enterprise Network Solutions, L.L.C. and/or its third party service provider be liable to you or any other person for any damages, including without limitation, and indirect, incidental, special or consequential damages, expenses costs, profits, lost savings or earnings, lost or corrupted data, or other liability arising out of, or related to, the services provided by Allied Enterprise Network Solutions, L.L.C. and/or its third party service provider or out of the installation, de-installation, use of, or inability to use your computer equipment, hardware, peripherals, or the network resulting from the services provided hereunder.

RELEASE OF LIABILITY: By requesting services from Allied Enterprise Network Solutions, L.L.C., you affirmatively release and hold harmless, Allied Enterprise Network Solutions, L.L.C. and/or its third party service provider from and against any loss, liability, or damage that you the owner or lessee may suffer, including but not limited to any loss of any data and the non-functioning of any component or element of your computer equipment of peripherals resulting from Allied Enterprise Network Solutions, L.L.C. and/or its third party service provider’s technicians, partners and/or third party service providers, regardless of the warranties, disclaimers and waivers particular service and shall constitute liquidated damages and are a reasonable estimate of damages to you.

CHANGES AND CANCELLATIONS: You may cancel or reschedule your service request if you give Allied Enterprise Network Solutions, L.L.C. at least 1 hour notice prior to the scheduled performance of service. Failure to do so will result in a $45.00 service cancelation fee (applies to scheduled ON-SITE and IN-HOME SERVICE).

Allied Enterprise Network Solutions, L.L.C. reserves the right to refuse service to anyone person or business.


Customer’s submission of a trouble ticket indicates clear and knowledgeable agreement to all terms and conditions stated in this form.
